The rules in Wyoming
- Small estate limit: $400,000 (Affidavit for payment of debts and delivery of personal property (W.S. 2-1-201)). Does not cover real estate. Heirs wait 30 days after the death. Limit is the entire Wyoming estate subject to administration, less liens. Affidavit is filed with the county clerk. - Simplified probate: Summary procedure: decree of summary distribution (W.S. 2-1-205), up to $400,000. Source
- Court fee: $310 for a $300,000 estate. W.S. 2-2-401: $110 filing fee + $40 court automation fee + $10 indigent civil legal services fee = $160 at opening. Plus a fee when the inventory is filed: $5 for value of $5,000 to $10,000, and $5 for each added $10,000 or part. $300,000 estate: $160 + $150 = $310. Bands: $160 opening fees plus the inventory fee, in $10,000 steps up to $1,000,000; above that the last band approximates $5 per $10,000 as 0.05% of value (can be up to $5 low between steps).
